02 · How it works in Michigan

Two claims, four benefits, and dates that do not move.

A personal injury claim here is usually two claims at once. The first is against your own insurer for no-fault benefits. The second is against whoever caused the harm, and it opens only when the injury clears the threshold the statute sets.

Both have deadlines, and they are not the same. Benefits generally must be applied for within one year, with a one-year look-back on each expense. A suit for injuries usually has three years.

The 2019 amendments made coverage a choice. Drivers who took a lower PIP level often learn what that means when the hospital bills arrive. Reading the policy is the first thing we do.
